  1. Introduction and effectiveness of the General Conditions

These general conditions of sale (hereinafter, “General Conditions”) have as their object the regulation of the purchase of products made via the internet, from the website wwwmaclo.it (hereinafter, the “Site”) in compliance with the Italian legislation of pursuant to Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the “Consumer Code”). The seller of the products and owner of the site is Maclò Srl.

The consumer who accesses the Site to make purchases (hereinafter “Customer”) is required, before sending the order, to carefully read these General Conditions.

  1. Choose and order the Products

The characteristics and the price of the various products for sale on the Site (hereinafter “Product” or “Products”) are shown on the page relating to each Product.

The Customer must add the Product to the “Cart”, then enter the shipping and billing data, then select the desired payment method and confirm the order only after having read the General Conditions and the Privacy Policy and confirmed the their acceptance.

By sending the order from the Site, which has the value of a contract proposal, the Customer acknowledges and declares that he has read all the information provided to him during the purchase procedure and that he fully accepts these transcribed General and Payment Conditions.

The contract stipulated between Maclò and the Customer must be considered concluded with the acceptance of the order by Maclò. This acceptance is communicated to the Customer through an e-mail confirming the order itself containing a reference to these General Conditions, the order number, the shipping and billing data, the list of Products ordered with their essential characteristics and the total price, including any delivery costs. Once the order is received, Maclò will check the availability of stocks for the fulfillment of the order. In the event that one or more Products are not available, Maclò Customer Service will promptly send an e-mail to the Customer who, within the next 12 hours, will have the right to reply to confirm the shipment of any additional Products available or cancel it. In case of no response within this period, the order will be considered confirmed and the available Products will be shipped. The amount relating to the missing Products will be reversed depending on the payment method chosen.

The information and characteristics relating to the Products are available on the Site.

For technological reasons, the Site cannot guarantee that the display of colors on the screen will always be accurate. Marginal differences between the description of the Product on the Site and the actual characteristics of the Product will not be considered as a cause of non-conformity of the Product. In the event that a non-compliant Product is delivered, the Customer may request the restoration, without charge, of the conformity of the Products by repair or replacement. The use of the coupon is governed by the following conditions of use:

– discount vouchers cannot be combined with other commercial initiatives;

In the event that Maclò does not receive these documents within the deadline specified in the e-mail request or receives expired or invalid documents, the contract will be considered terminated by law pursuant to and for the purposes of art. 1456 of the Italian Civil Code, and the order consequently canceled, without prejudice to Maclò’s right to compensation for any damage it may incur due to the non-compliant behavior of the user. The termination of the contract, of which the user will be notified by e-mail, no later than 5 working days from the expiry of the deadline for sending the documents requested by Maclò, will result in the cancellation of the order with consequent refund of the amount. Total, if paid, by re-credit on the same payment method used. In the event of timely receipt by Maclò of the valid documentation requested, the delivery terms applicable to the order will start from the date of receipt of such documentation.

Maclò uses a payment gateway to authorize payments for Orders (“Payment gateway”); Consequently, it does not directly manage any financial information relating to the Payment Method used by the Customer, nor does the Site process any financial information provided for the completion of the Order. The Payment Gateway protects the details of the credit or debit card used by encrypting sensitive information to ensure that it is transmitted securely. The Site adopts Secure Socket Layer (SSL) technology to ensure a higher standard of security on each Order.

PayPal

PayPal, an eBay company, is a fast and secure payment system. Once this payment method has been selected and then by clicking on “Place Order” a window will open overlapping where you can choose between two options:

– Make the payment with your personal Paypal account;

or

– Pay with any credit / prepaid card (Visa, Visa Electron, Postepay, PayPal card, Mastercard).

The system communicates directly with PayPal in total safety so Maclò never gets to know the data relating to your payment method. The amount will be charged directly to the credit card (Visa, Visa Electron, Postepay, Mastercard) or prepaid (PostePay) card that you have chosen or associated with your PayPal account. For each transaction you will receive a confirmation e-mail from PayPal. The order amount will be charged to your PayPal account at the time of order acquisition. In the event of cancellation, the amount will be refunded to your PayPal account or to your credit / prepaid card.

If you have a card belonging to the American Express or Discover circuits, you can make the payment exclusively from the PayPal.com site.

Select PayPal or Credit Card as the payment method and when the window opens, click on the “Pay with Paypal” button;

Once on the PayPal site, select “Don’t have a PayPal account?” and enter your American Express Discover card details.

Payment by PayPal or Credit Card speeds up order shipping times, because the transaction is verified instantly and your order goes straight to processing.

  1. Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure by courier from Monday to Friday, excluding holidays and national holidays. Maclò is not responsible for unforeseeable delays or those not attributable to it.

Once the Products have been shipped, the Customer will receive a confirmation e-mail which will include a link to refer to for tracking the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within a period of 72 working hours from the day on which the Customer has received a specific order confirmation e-mail. This is not guaranteed for areas such as Calabria, Sicily and Sardinia, or areas that are difficult to reach.

  1. Applicable law and disputes

These general conditions of sale and the sales contracts regulated by them are governed by Italian law.

All disputes relating to these General Conditions of Sale and the contracts regulated by them will be known by the competent Court of the place of domicile or residence of the Customer according to the applicable law or, at the choice of the same, by the Court of Milan. Without prejudice to the possibility of promoting the out-of-court resolution of disputes, as provided for by Articles 66 and 141 of the Consumer Code.

Shipping and Returns

Shipping

Orders placed on www.maclo.it can only be delivered on the national territory by online order. If you belong to the European Union, send an e-mail to info@maclo.it and we will assist you in placing an order by providing you with feasibility and delivery times. Orders will soon also be possible outside the EU and in other currencies.

For purchases made from abroad, shipping costs € 12 for all purchases up to a total of € 199. For purchases from € 200 upwards, shipping is free.

After the order confirmation e-mail, you will receive an e-mail with the tracking number of the shipment as soon as it is ready. Orders are delivered Monday to Friday, excluding holidays.

The courier makes several delivery attempts, if none are successful for reasons not attributable to Maclò, Maclò will refund the product by deducting the delivery and return costs.

Maclò accepts returns for any reason within 14 days from the date of delivery of the order. The cost is € 10 (not applicable for defective product).

You can make a return request by following the procedure described here:

Send an e-mail to info@maclo.it indicating the name, address for the collection of the goods, the order number and the reason for the return

Wait for the Customer Service to process the request and send the shipping label to be applied to the envelope containing the return

Place the product in its original box, making sure it is in its original condition

Maclò will refund after receiving the return and checking the condition of the product within 5 working days

Maclò carries out a quality control on each product to prevent the customer from receiving defective products. Despite this, in the event that the customer encounters this situation, it must be reported within 24 hours of receiving the order by sending an e-mail to Customer Service certifying the defect. Once this is confirmed, Maclò will assume all costs associated with the replacement of the product.
