1. Introduction and Effectiveness of the General Conditions

These general sales conditions (hereinafter, "General Conditions") govern the purchase of products made through the Internet from the website www.maclo.it (hereinafter, the "Website") in compliance with Italian legislation, specifically Legislative Decree 206/2005 and subsequent amendments and integrations (hereinafter, the "Consumer Code"). The seller of the products and the owner of the Website is Maclò Srl.

The consumer who accesses the Website to make purchases (hereinafter, the "Customer") is required, before placing an order, to carefully read these General Conditions.

2. Choosing and Ordering Products

The features and prices of the various products for sale on the Website (hereinafter, "Product" or "Products") are listed on each Product's respective page.

The Customer should add the Product to the "Cart," then enter shipping and billing information. Afterward, they must select the desired payment method and confirm the order only after reading and accepting the General Conditions and Privacy Policy.

By submitting an order through the Website, which constitutes a contractual proposal, the Customer acknowledges and declares that they have read all the information provided during the purchase process and fully accept these General Conditions and payment terms.

The contract between Maclò and the Customer is considered concluded upon Maclò's acceptance of the order. This acceptance is communicated to the Customer through an order confirmation email, which includes a reference to these General Conditions, the order number, shipping and billing information, the list of ordered Products with their essential characteristics, and the total price, including any delivery charges. The Customer should review the confirmation email, and if they identify any errors in the order, they have 3 hours from receiving the email to contact Customer Service directly through the Website using the provided contact form accessible from the "Contacts" page or by sending an email to info@maclo.it. After this period, the order will be processed for shipment, and no further changes will be accepted, without prejudice to the Customer's rights as outlined in the following Article 7.

Upon receiving the order, Maclò will verify the availability of stock for order fulfillment. If one or more Products are not available, Maclò's Customer Service will promptly send an email to the Customer, who, within the next 12 hours, has the option to confirm the shipment of any additional available Products or cancel the order. In case of no response within this timeframe, the order will be considered confirmed, and the available Products will be shipped. The amount related to the missing Products will be refunded according to the chosen payment method.

3. Product Information

Information and characteristics of the Products are available on the Website.

Due to technological limitations, the Website cannot guarantee that the display of colors on the screen will always be accurate. Minor differences between the Product description on the Website and the actual characteristics of the Product will not be considered as a cause of non-conformity of the Product. If a non-conforming Product is delivered, the Customer may request rectification, free of charge, of the Product's conformity through repair or replacement. If this is not possible, the Customer has the right to a corresponding reduction in the purchase price or a refund of the purchase price and (if incurred) shipping costs.

4. Coupon Codes – Promotions – Gifts Maclò may include discount coupons inside packages, send them via email, or through partner websites. These coupons can be used within the indicated expiration date.

The discount coupon should be entered on the cart page within the "coupon code" box and activated using the "apply code" button. The system will update the total order amount net of the coupon value.

The use of coupons is subject to the following conditions:

  • Coupons cannot be combined with other promotional initiatives.
  • Coupons may have a predetermined value or be in the form of a percentage discount.
  • They have an expiration date specified on the coupon itself.
  • Coupons do not entitle the holder to change, and they cannot be fully or partially refunded. They must be used before the expiration date. The voucher cannot be resold.
  • Coupons can only be used for online product purchases.
  • For fixed amount coupon codes, if the coupon value is insufficient to cover the order amount, the buyer can pay the remaining balance using the payment methods provided by the Website.

5. Prices and Shipping

Product prices include VAT and are expressed in euros (€). Regarding shipping costs, the Customer should refer to the "Shipping Costs" section of the order. Throughout Italy, shipping is free for orders over €99.

6. Payment Methods The Customer can pay for the Products and related delivery charges by credit card or PayPal.

Credit Card

Payment for Products purchased on the Website can be made directly through the Website using a credit card. Maclò accepts VISA, Mastercard, and American Express credit cards. The charge for the Total Amount will be made when the order is transmitted. By selecting the "Remember payment information for future orders" checkbox or accessing the "Payment Methods" section of their personal account, the Customer can authorize the storage and reuse of credit card data for future purchases, eliminating the need to enter card details for each purchase. The Customer can revoke this authorization for future purchases at any time by accessing their personal account and deleting the saved cards.

To ensure payment security on the Website and prevent potential fraud, Maclò reserves the right to request that the Customer send a front/back copy of their ID card, and if the order's owner is different from the cardholder, the cardholder's ID card, all via email. These documents must be valid. The email requesting these documents will specify the deadline for Maclò to receive them. This deadline will not exceed 5 working days from the date the Customer receives the request. While waiting for the requested documents, the order will be suspended. The Customer is obligated to send the required documents within the specified timeframe.

If Maclò does not receive these documents within the specified timeframe or receives expired or invalid documents, the contract will be considered terminated by operation of law according to Article 1456 of the Italian Civil Code, and the order will be canceled. Maclò reserves the right to seek compensation for any damage resulting from the Customer's non-compliance. The Customer will be notified via email of the contract's termination within 5 working days of the document submission deadline. The cancellation of the order will result in a refund of the Total Amount, if paid, through the same payment method used. If Maclò receives valid documentation in a timely manner, the applicable delivery terms for the order will start from the date of receiving this documentation.

Maclò uses a payment gateway to authorize Order payments ("Payment Gateway"). Consequently, it does not directly manage any financial information related to the Customer's chosen payment method, and the Website does not process any financial information provided for order completion. The Payment Gateway protects credit or debit card details used by encrypting sensitive information to ensure secure transmission. The Website adopts Secure Socket Layer (SSL) technology to provide a higher level of security for each Order.

PayPal

PayPal, a company within the eBay group, is a fast and secure payment system. Once this payment method is selected and the "Place Order" button is clicked, a window will pop up, allowing the Customer to choose between two options:

  • Make payment with your personal PayPal account.
  • Pay with any credit/prepaid card (Visa, Visa Electron, Postepay, Carta PayPal, Mastercard).

The system communicates directly with PayPal securely, so Maclò never becomes aware of the Customer's payment method details. The amount will be charged directly to the credit card (Visa, Visa Electron, Postepay, Mastercard) or prepaid card (PostePay) chosen or associated with the PayPal account. The Customer will receive a confirmation email from PayPal after each transaction. The order amount will be debited from the PayPal account at the time of order acquisition. In case of cancellation, the amount will be refunded to the PayPal account or the Customer's credit/prepaid card.

If the Customer has a card belonging to the American Express or Discover networks, they can only make payments through the PayPal.com website.

Select PayPal or Credit Card as the payment method and, upon opening the window, click on the "Pay with Paypal" button.

Once on the PayPal website, select "Don't have a PayPal account?" and enter your American Express or Discover card details.

Payment with PayPal or Credit Card expedites order shipment as transactions are instantly verified, and the order goes into processing immediately.

Scalapay

When buying with Scalapay, you receive your order immediately and pay in the number of installments you have chosen. Please note that the installments will be transferred to Incremento SPV S.r.l., related parties, and their assignees, and you authorize this transfer.

7. Transport and Delivery

The Products purchased on the Website will be delivered to the address provided by the Customer during the purchase process via a courier service from Monday to Friday, excluding holidays and national holidays. Maclò is not responsible for unforeseeable delays or delays that are not attributable to it.

Once the Products are shipped, the Customer will receive a confirmation email containing a link for tracking the shipment.

In any case, except for force majeure or unforeseen circumstances, the ordered Products will be delivered within 72 working hours from the day the Customer receives the order confirmation email. This does not apply to areas such as Calabria, Sicily, and Sardinia, or hard-to-reach areas.

8. Applicable Law and Disputes

These general sales conditions and the contracts regulated by them are governed by Italian law.

Any disputes related to these general sales conditions and contracts regulated by them will be handled by the competent court in the place of residence or domicile of the Customer according to the applicable law, or, at the Customer's choice, by the Milan Court. The possibility of promoting extrajudicial dispute resolution, as provided for in Articles 66 and 141 of the Consumer Code, is reserved.
